ENTIRE AGREEMENT: This agreement contains the entire understanding between Photos by Yeti, LLC (aka Yetman Photography) and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties.
RESERVATION: A signed contract and retainer of $900 are required to reserve your wedding day coverage. Amount of deposit can fluctuate depending on the event and previous arrangements. This contract between Photos by Yeti and the client shall not become effective until it is signed and the initial amount due has been paid. At the time the contract takes effect, Photos by Yeti, LLC shall reserve the date and time agreed upon, and not make any other reservations or accept any other clients for said date and time. For this reason, in the event that the client cancels the contract for any reason, all money paid shall be retained by Photos by Yeti, LLC in order to offset its loss of business.
HOUSE RULES: The Photographer is limited by the guidelines of the ceremony official or reception site management. The client agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is client's responsibility; Photos by Yeti, LLC will offer technical recommendations only; Photos by Yeti, LLC cannot guarantee a specific shot. A wedding is not a controlled environment. We will do our best to get the shots you request but cannot guarantee it. Breaks, such as meals, equipment checks or bathroom breaks are necessary. We will do our very best to avoid taking breaks during any key moments, but cannot guarantee every moment.
FILM and COPYRIGHTS: Until final payment for services is made, the photographs produced by Photos by Yeti, LLC are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without the written permission of Photos by Yeti, LLC. Upon final payment by the client, limited copyright ownership of the resulting images will be transferred to the client under the following conditions: The digital copies of the delivered images are the property of the client for personal use and for the purposes of the reproduction and giving of photographs to friends and relatives. The original RAW files remain the property of Photos by Yeti, LLC and will not be distributed to the client. The client must obtain written permission from and compensate Photos by Yeti, LLC prior to the client or their friends and relatives publishing or selling the photographs for profit.
EXHIBITION: Client grants Photos by Yeti, LLC permission to display selected images as an example of Photos by Yeti, LLC's work and for entrance into photographic competitions and release all claims to profits that may arise from use of images.
MEALS: Both photographers must be included in the dinner count for any shoot of 6 hours or more if dinner is being served, whether it be a “vendor” meal or a “guest” meal. We cannot guarantee coverage of your event during dinner if we are not seated in the same room as the bridal party and guests. While we will continue to shoot during important moments such as toasts, we do not photograph guests while they are eating so they can enjoy their meal.
MODEL RELEASE. The client hereby grants Photos by Yeti, LLC the irrevocable and unrestricted right to use and publish photographs of the client or in which the client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium. The client hereby releases Photos by Yeti, LLC and its employees from all claims and liability relating to said photographs.
ENGAGEMENT SESSIONS: Engagement shoot scheduling is limited to the photographer’s schedule, weather limitations and travel time. Certain times and locations may not be available during peak wedding season due to these factors. Photos by Yeti, LLC cannot guarantee a time and location will always be available.
LIMIT OF LIABILITY: In the unlikely event that the Photographer is injured or becomes too ill to cover the event, Photos by Yeti, LLC will make every effort to secure a replacement photographer for the same fee. If the situation should occur and a suitable replacement is not found, the 2nd shooter will cover the event in full at a $300 discount. If both photographers are unable to cover the event, responsibility and liability is limited to the return of all payments received for the event package. Photos by Yeti, LLC takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons beyond Photos by Yeti, LLC's control, liability is limited to the return of all post retainer payments received for the event. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.
FORCE MAJEURE: Photos by Yeti, LLC shall not be liable to the client for delays in performance beyond reasonable control and without its fault or negligence, including but not limited to accident, illness, acts of God, acts of the government in its sovereign capacity, fires, floods, epidemics, quarantine restrictions, strikes, bad weather, and delays of Photographer's suppliers at any tier.
EXCLUSIVITY/GUEST PHOTOGRAPHY: It is understood that Photos by Yeti, LLC will act as the sole and exclusive wedding photographer. Flashes from guest’s cameras may ruin shots taken by Photos by Yeti, LLC and the client acknowledges that they are responsible for notifying all of their guests that guest photography must not interfere with work of Photos by Yeti, LLC Because of time constraints and the need for subjects to pay full attention to the professional photographer, guest photography must be deferential to the professional photographer. Guest photographers are not permitted on the location shoots as per the wedding schedule, unless other arrangements are made.
RETAINER: In the event of cancellation by the client, the retainer paid is non- refundable. The client agrees to provide cancellation notice in writing and releases Photos by Yeti, LLC from any responsibilities and liabilities.
FINAL PAYMENT: Final Payment is due two weeks before your wedding day. A late fee of $50 per week may be added for payments made after the due date. If payment is not received by the wedding date, Photos by Yeti, LLC is released from all responsibility to cover the event.
I / we, the undersigned Contracting Party, hereby warrant that I am / we are competent to contract in my / our own name(s). I / we confirm that I / we have read the herein agreement prior to its execution and I / we are fully familiar with the contents thereof. This agreement shall be binding upon us and our heirs, legal representatives and assigns. And, we certify that we have received a complete copy of this agreement with all blank lines completed.
